Yes, smoke detectors are mandatory in Belgium — however, the legislation is regulated at the regional level. Depending on whether you live in Flanders, Wallonia or Brussels, different requirements apply regarding quantity and placement.

Regional Regulations at a Glance

Flanders

Since 1 January 2020, all dwellings in Flanders must be equipped with smoke detectors. The rules:

  • At least one smoke detector per floor
  • In every escape route (hallway, staircase) a detector must be installed
  • In bedrooms, installation is recommended but not mandatory
  • Applies to all rental properties and owner-occupied homes

Wallonia

Wallonia was a pioneer and introduced the smoke detector obligation since 2010:

  • At least one smoke detector per floor
  • Mandatory locations: hallways and staircases
  • For rental properties, the landlord must ensure installation

Brussels

The Brussels-Capital Region has had the obligation since 2005 — the oldest regulation in Belgium:

  • One smoke detector per floor
  • Mandatory in escape routes (hallways, stairs)
  • Applies to all residential buildings

AREI Connection: Smoke Detectors and the Electrical Inspection

An important note: smoke detectors are not directly regulated by the AREI. The AREI primarily regulates the electrical installation — cables, fuses, earthing, etc. Art. 9.1.2 Nr. 2 requires that the electrical installation file includes a site plan; its prescribed content is exhaustively defined (sockets, switches, lighting points, and fixed appliances or machines) and does not include smoke detectors.

Since smoke detectors are not part of the AREI-regulated electrical installation, they are not subject to the electrical inspection (keuring); a missing smoke detector does not result in an AREI deficiency. Some installers or inspectors nevertheless show smoke detectors on the situation plan for information, to document the position of all relevant devices in the dwelling.

Maintenance and Replacement

  • Monthly: Press the test button to check functionality
  • Annually: Thorough testing and dust removal
  • Every 10 years: Replace the smoke detector completely (sensors lose sensitivity)
  • Only use detectors with CE marking and compliant with NBN EN 14604
